We bought a villa a few years ago with a large plot at the side we use as a garden. The guy who sold us the villa does not like the way i am landscaping it, We dont have the title deeds yet, they are applied for.

He has put a swimming pool right on our boundary and now does not want me to plant trees there in case leaves fall in his pool or roots damage the pool. He is very nasty, does he have any rights?

Can you be more specific about what you mean when you say that the swimming pool is “right on our boundary”? There are laws relating to the distance between a boundary wall and the edge of a swimming pool and it would be interested to see whether those have been breached or not.

we will be there on thursday but a rough estimate is 3 feet, we will check thursday

what is the minimum distance please?

The usual rule is 3 meters if the boundary adjoins a road or other public area. This can be reduced if the planners agree to 1.5 meters where that is not the case

This is very interesting - I wonder how many adhere to these rules.

Does the 3 metre rule apply with private houses, i.e. next door's neighbour's swimming pool and your own boundry wall. ?

the swimming pool is on the boundary which adjoins our garden only so i dont think this applies

thankyou for helping

Louise do you know if we can drill a borehole for irrigation for the garden?

Hi Louise

back in UK, we measured it and it is 90cm from our boundary...they are still demanding we move our trees as the pool is at risk...and our leaves will contaminate their pool!

As I mentioned in my original posting, the usual rule is that the swimming pool should not be closer than 1.5m from the boundary of the neighbouring property. Therefore, if this pool is only 90cm from your boundary it sounds as if it cannot have appropriate planning permission. The short answer is that of course you do not have to move your trees and this is particularly so if there is a possibility that the positioning of the pool is in contravention of planning permission.

A question has also been posted about drilling a bore hole and I understand that this is something that permission is needed for and that many bore holes on the island are in fact illegal. For further information, the services of an architect/surveyor should be engaged.
